The Empresa Pública para la Gestión del Turismo y del Deporte de Andalucía, S.A. is a commercial company in the Andalusian Public Sector, in accordance with article 4 of Legislative Decree 1/2010, of 2 March, which approves the Consolidated Text for the General Law of Public Finance of the Andalusian Regional Government, and as such is governed by Law 9/2007, of 22 October, by the Andalusian Regional Government, by Law 4/1986, of 5 May, for the Heritage of the Autonomous Community of Andalusia and by the provisions included therein, as well as by any specific regulations and all applicable regulations included in civil, commercial and labour law.

The company is considered to be a means and technical service belong to the Andalusian Regional Government's Administration and its corresponding public and private instruments with regard to activities included in its corporate purpose, being able to grant assignments in accordance with the regulations of the Autonomous Community of Andalusia.

Furthermore, and for the purposes established in article 3 of the Consolidated Text for Public Sector Contracts, approved by Royal Legislative Decree 3/2011, of 14 November, the company is considered to be a contracting authority.
